January 30, 2012 - Cell Phones and CMVs - The Federal Motor Carrier Safety Administration (FMCSA) and Pipeline Hazardous Materials Safety Administration (PHMSA) issued a final rule amending the Federal Motor Carrier Safety Regulations (FMCSRs) and the Hazardous Materials Regulations (HMRs).  This rule was issued to improve safety by reducing the frequency of distracted driving-related crashes, fatalities, and injuries involving drivers of commercial motor vehicles (CMVs).

Motor carriers are now prohibited from requiring or allowing drivers of CMVs to use mobile, hand-held telephones while operating CMVs.  The Final Rule becomes effective January 3rd, 2012. Read More...

January 16, 2012 General Chairman Dodd's general letter to the membership, including a copy of out Bylaws. "This letter is being sent to you because you are a member of the Pennsylvania Federation BMWED - Teamsters.  Enclosed is a copy of the most recent bylaws that were adopted by local lodge delegates at our regular August 2011 Convention.   We are mailing it to you on the birthday of Doctor Martin Luther King Jr., the great champion of the working class, because our Federation and our bylaws seek to honor his memory with our commitment to social justice, sacrifice, struggle and rank and file democracy." November 21, 2011 Correspondence between Local Lodge 3014 and the BMWED National Division discussing the eligibility requirements for holding union office, and the "good Standing" status maintained by dues history. October 25, 2011 BMWED National Division and Federation Dues for calendar year 2012 are based on the average hourly rate of pay for maintenance of way employees during calendar year 2010.  The average hourly rate of pay for calendar year 2010 was $22.57/hour. September 10, 2010 Freight members are reminded that Federal Law now requires the reporting of Social Security Numbers (SSNs) for covered dependents to the Centers for Medicare & Medicaid Services (CMS). This includes participants of all medical plans, including the Railroad Plans listed above. In addition, if a covered dependent is eligible for Medicare, then the Medicare Health Insurance Claim Number (HICN) is also required. Read Reminder Here.

May 17, 2010 The National Division announces a new Accounts Receivable and Membership Tracking program which will enhance processing of payments, refunds and reporting requirements. Read Secretary Treasurer Geller's memo here.

April 16, 2010 Congressional Track Inspection Time Study. The FRA will be mailing their own track inspector survey to randomly selected track inspectors. This survey will address several aspects of the track inspection process including the intervals for inspection of different classes of track, methods of inspection, remedial actions, and the speed at which railroad track inspection vehicles operate and the scope of the territory that they cover. April 1, 2010 Secretary Treasurer Geller writes to Local Lodge Secretary-Treasurers regarding Form 990-N (e-Postcard). The Internal Revenue Service now requires local lodges to electronically file Form 990-N, also known as the e-Postcard, annually by August 15th of each year. View letter here

April 5, 2010 Secretary Treasurer Geller writes to Local Lodge Secretary-Treasurers regarding Form's LM-3 or LM-4, which are required to be filed with the U.S. Department ofLabor, containing financial information about your local lodge for the fiscal year ended March 31,2010. Form LM-3 is required to be filed by local lodges that had $10,000.00 or more in total annual receipts for the fiscal year. Form LM-4 is required to be filed by local lodges that had less than $10,000.00 in total annual receipts for the fiscal year. View letter here

April 1, 2010 Secretary Treasurer Geller's letter describing the payroll service offered by National Division and to explain how Lodge Secretary-Treasurers should reimburse Convention delegates for lost wages and out-of-pocket expenses. View letter here

April 1, 2010 Quarterly Payroll Report Form OE-I a. This letter is intended for those lodges that issue, directly from tbeir lodge account, any checks for wages or dues reimbursements, other than a dues reimbursement to a retired secretary-treasurer. December 8, 2009 The IRS has decreased the Standard Mileage Rate, effective January 1, 2010. The current rate of $.55 per mile is reduced to $.50 per mile. November 6, 2009 The National Carriers Conference Committee (NCCC) serve Section 6 notice to the BMWED for the 2010 round of bargaining. Wages, Work Rules, and Healthcare are at issue. View notice here.

Novermber 2, 2009 The rates for the 2010 renewal of the Railroad Employees National Health and Welfare Plan ("the Plan") have been set to increase from $170.96 to $200.00. Read President Simpson's letter here.

October 22, 2009 Results from the 2009 BMWED Contract Survey are in. The return numbers indicate that a little less than half of our members participated in this polling. Questions were answered such as “…how would you rate ‘your pay for the work you do’ and ‘your health coverage” were tallied and our responses. View the survey questions and the survey results.

October 21, 2009 BMWED REPRESENTATIVES MEET TO FINALIZE NATIONAL BARGAINING DEMANDS, Cincinnati, OH – BMWED National Division President Freddie Simpson convened a meeting today for the purpose of reviewing membership surveys and finalizing bargaining demands that will be served on the nation’s freight railroads in November. The national contract with most freight railroads will expire January 1, 2010 and the next round of bargaining will begin. View the National Division corrospondence here.

August 25, 2008 NEW Department Of Transportation Urine Specimen Collection Guidelines (49 CFR Part 40)

The procedures for collection of urine under these rules are very specific and must be followed whenever a DOT-required urine specimen collection is performed. (The only exception is the Federal Railroad Administration's Post-Accident Toxicological Testing Program in which a railroad representative will provide the collector specific instructions and a testing kit.) These procedures, including use of the Federal Drug Testing Custody and Control Form (CCF), apply only to DOT-required testing. While employers may use these collection and testing procedures for testing under employer or state authority, they must not use a Federal CCF nor can they imply that company tests are conducted using DOT authority.
